The Utah Justice Foundation has a MISSION to inform, to educate, and to seek Justice for ALL involved with the criminal justice system in the state of Utah.

We seek to help criminal defendants receive fair and balanced Justice for their particular circumstances and case! We seek long-term solutions for each defendant, while being mindful of the interests of victims and society.



COGNITIVE RESTRUCTURING & TREATMENT

What does it really mean to seek long-term solutions for each defendant, while being mindful of the interests of victims and society?

In the case of a defendant who makes poor decisions, with anger or violence issues, or any other unacceptable behavior for that matter, the Utah Justice Foundation seeks a solution that will solve the CAUSE of the criminal behavior. The reason? We have an objective for the defendant to exit the criminal justice system permanently!

Sounds simple, right? Yes it does sound simple, but in fact it is the much more difficult road to travel. It is far easier to put the offenders in jail and make them pay hefty fines, and then hope that they "learn their lesson."

The current criminal justice system tends to focus most on punishment because it's easier, less time consuming, and perceived to be less risky and expensive. The primary problem with this approach is the focus is not on the CAUSE of the criminal behavior.

Many other organizations simply direct defendants where THEY wish. We do not!

At the Utah Justice Foundation, we seek to use non-judgmental and forward-thinking approachs to allow each defendant to realize his or her true desires for a life in accord with societal norms! Then, together, we design a program for the defendant to achieve what he or she wants for his or her life in addition to paying any debts owed to victim(s) and to society.

Again, the objective is for each and every defendant to exit the criminal justice system permanently - without repeating offences - thereby achieving long-term benefits for the defendant, for law enforcement, for the courts, and for society and the citizens of Utah!



WHEN IS COGNITIVE RESTRUCTURING REQUIRED?

The Utah Justice Foundation provides the following general information with regard to the role that Cognitive Restructuring Treatment/Education Classes can play in connection with a criminal defendant's case and the criminal justice system in the state of Utah. Our Featured Service Provider (see right column) is available to assist you or anyone you may care about. Generally speaking, cognitive restructuring classes may be required by the Court for probation to be ordered as a part of sentencing in cases where "thinking errors" were (or is alleged to have been) involved. Therefore, the Court may order this type of treatment and education in connection with cases involving the following types of charges:

  • Assault.
  • Battery.
  • Child Abuse.
  • Retail Theft.
  • Spousal Abuse.
  • Domestic Violence.

Many, if not most, defendants wait to begin their treatment/education classes until after they are ordered by the Court to do so. We believe that this is a huge mistake. The most important thing to realize is that treatment and education classses are for the defendant's benefit, so the sooner he or she gets started, the sooner the personal benefits may be realized.

The Utah Justice Foundation strongly recommends beginning cognitive restructuring classes, or any treatment/education classes immediately, and most importantly, before appearing before the Court for sentencing. Now, this would definitely be the best approach if the defendant anticipates pleading guilty to the charge(s). This issue of when to start treatment may be approached a bit differently if the defendant does not anticipate a guilty plea or conviction given a competent attorney's opinion.
